Hazard Communication Program

Objectives: By the end of this section, participants will be able to ascertain the requirements of the Hazard Communication Program and assess compliance with this program.

Why this section is important:  An employer who does not comply with HAZCOM requirements incurs considerable potential liability (in the forms of OSHA fines, lawsuits, worker compensation insurance rate hikes, criminal charges, etc.).

Hazard Determination

Requires employers to identify and evaluate all chemicals used in the workplace.

Based on two hazard categories:

  • Listed Hazards
  • Defined Hazards

 

Listed Hazards

  • Any chemical listed in 29 CFR 1910 Subpart Z
  • Any chemical listed in the Threshold Limit Values for Chemical Substances and Physical Agents and Biological Exposure Indices, American Conference of Governmental Industrial Hygienists
  • Any chemical listed in the National Toxicology Program Annual Report on Carcinogens
  • Any chemical listed by the International Agency for Research on Cancer, Monographs
  • Any chemical regulated by OSHA as a carcinogen

 

Defined Hazards

Specified by OSHA as physical or health hazards, such as combustible liquids, oxidizers, corrosives, reproductive toxins and non-toxins

excluding:

  • Wood and wood products (except wood dust)

  • Regulated hazardous waste

  • Tobacco products
  • Food
  • Drugs
  • Cosmetics
  • Alcoholic beverages
  • Agricultural or vegetable seed treated with pesticides
  • Various types of pesticides

Material Safety Data Sheets (MSDS)

Contain specific chemical hazard information and must be available to employees working with or near the hazardous chemical

 

 

Material Safety Data Sheet Requirements

  • Hard copies of the Material Safety Data Sheets (MSDS) for chemicals must be maintained by employer
  • Chemical inventory list must be maintained by the employer
  • Material Safety Data Sheets must be accessible to employees during each work shift.  There is some room for interpretation

Chemical Labeling Requirements

The label must contain:
  • The Identity of the chemical
  • The name and address of the manufacturer or importer
  • Warning words, including, but not limited to, DANGER, CAUTION, WARNING, FLAMMABLE

Many manufacturers and distributed have adopted the ANSI standard, which requires the following information on the label:

  • Chemical identity
  • Warnings (e.g., DANGER, CAUTION, WARNING, or FLAMMABLE)
  • Physical and health hazards
  • Precautionary methods (protective clothing, equipment, procedures)
  • Procedures in case of contact or overexposure
  • Antidotes for poisons
  • Instructions to medical staff
  • Fire control procedures
  • Spill or leak control procedures
  • Storage and handling procedures

Chemicals that are regulated by another Federal agency are exempted from HAZCOM labeling regulations, including:

  • Regulated foods and drug
  • Regulated alcohol
  • Consumer products (ORM-D)
  • Regulated pesticides
  • Tobacco products
  • Temporary containers (used by one person within one shift). If another employee uses that container during that shift, the container must be labeled. The container must be emptied at the end of the work shift or labeled.
  • Regulated hazardous wastes
  • Wood and wood products

 

Employee Training

Is required:
  • At the time of their initial assignment
  • Whenever a new physical or health hazard is introduced into the area

 

Training Topics

  • The hazard communication standard and its requirements of the standard
  • The components of the hazard communication program in the employees' workplace
  • Operations in work areas where hazardous chemicals are present
  • Where the employer will keep the written hazard evaluation procedures, communications program, lists of hazardous chemicals, and the required MSDS forms
  • How the hazard communication program is implemented in that workplace, how to read and interpret information on labels and the MSDS, and how employees can obtain and use the available information
  • The hazards of the chemicals in the work areas
  • Measures employees can take to protect themselves from the hazards
  • Specific procedures put into effect by the employer such as engineering controls, work practices, and the use of personal protective equipment.

 

Written Program

A written program must provide:
  • A list of hazardous chemicals in their workplace
  • MSDS and labels for each hazardous chemical
  • Methods used to provide employee information and training
  • Methods used to inform employees of hazards of non-routine work
  • Information of precautionary labels and other forms of warning for known hazardous chemicals in the workplace
  • Methods used to inform contractor employers of any hazardous chemicals to which contractor employees may be exposed.

 

Trade Secrets

The chemical manufacturer may withhold the chemical identity, including the chemical name and other specific information, from the MSDS.

Under special conditions, this secret information may be obtained by health care professionals. OSHA defines health care professionals as including physicians and industrial hygienists.

 

Thought Questions (you do not need to respond)

A pool technician uses muriatic acid (hydrochloric acid), a strong acid, to treat pools.  For one site, he has to park and carry the muriatic acid more than 100 yards.  Do you think he/she have to carry the MSDS on his/her person?

The owner of the pool does not store muriatic acid at the site, but muriatic acid is added to the pool.  Do you think the pool owner have to keep the MSDS sheet for muriatic acid on the premises?
